Buyer Terms & Conditions

1. Introduction

These AutoMatch Buyer Terms and Conditions ("Terms") apply when you submit a vehicle request through the AutoMatch platform ("Platform"). By submitting a request, you agree to these Terms.

A Buyer is a person or legal entity that submits a vehicle request through the AutoMatch platform.

2. Dealer proposals, availability, and dispute resolution

AutoMatch is a vehicle matching platform only. AutoMatch, its owners, directors, developers, shareholders, and employees are not the seller of any vehicle shown, proposed, inspected, test-driven, or purchased through AutoMatch.

Any vehicle sale, deposit, finance arrangement, warranty, trade-in arrangement, or purchase agreement is solely between the Buyer and the relevant Dealer.

AutoMatch is not responsible for inaccurate or misleading information supplied by a Dealer, including vehicle details, ownership information, pricing, warranties, finance information, trade-in representations, or any unlawful conduct by a Dealer in relation to a vehicle or transaction.

Dealers who submit vehicles through AutoMatch are required to confirm the vehicle's availability, driveaway price, and other relevant details at the time a proposal is submitted.

Vehicle availability and pricing can change after a proposal is submitted. Dealers are expected to honour the vehicle details, pricing, and commitments submitted through AutoMatch at the time the proposal is made. However, a vehicle sale remains subject to normal dealership processes, including confirmation that the vehicle remains available, buyer identity where required, finance approval (if applicable), trade-in inspection (if applicable), and any other matters outside AutoMatch's control.

AutoMatch does not guarantee that a vehicle will remain available, that a Dealer will accept a Buyer's offer, that finance will be approved, that a trade-in value will be accepted, or that a vehicle sale will ultimately be completed.

Submitting a Buyer request does not guarantee that suitable vehicle proposals will be available. Where suitable vehicles are available, AutoMatch may present a limited number of Dealer proposals selected using its matching process. If no Dealer submits a suitable vehicle, or no proposal meets AutoMatch's quality requirements, a Buyer request may result in no available matches.

If a Buyer believes that a Dealer proposal shown through AutoMatch was materially inaccurate, no longer available when represented as available, not honoured, or did not match the information presented through AutoMatch, the Buyer should first raise the issue directly with the Dealer. The Buyer may also notify AutoMatch so that we can review the matter.

Where AutoMatch is notified of a dispute, we may review information reasonably available to us, including the Buyer request, Dealer proposal, submitted vehicle details, submitted pricing, proposal timestamps, result release timestamps, Dealer confirmation records, and related communications where available. We may ask both the Buyer and Dealer to provide further information.

AutoMatch may, at its discretion, take steps including asking the Dealer to clarify or correct the issue, requesting that the Dealer contact the Buyer, recording the issue against the Dealer, limiting or removing the Dealer's access to future Buyer requests, or taking no further action where the issue appears resolved, outside AutoMatch's control, or not supported by the available information.

Nothing in these Terms limits any rights a Buyer may have under New Zealand law, including the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other applicable legislation. Buyers and Dealers remain responsible for obtaining their own independent advice where appropriate.

3. Governing Law

These Terms are governed by the laws of New Zealand.

Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
